General

Quotations/Estimates

  • All quotes are written as a fixed cost/hourly allotment and include all work as specified in the quote. Departures from the work and or specifications outlined in the quote which result in major changes or the requirement of additional time for execution will be charged at an hourly rate. These hours will occur during normal business hours; all other hours will be billed at an overtime (x 1.5) rate. All prices are in Australian dollars inclusive of GST.
  • Quotes presented are an estimate of the number of hours expected to complete this project based on previous work; however, Flying Fox Multimedia reserves the right to bill for the actual number of hours of work. Should change of project specifications or major revisions require further time for execution, Flying Fox Multimedia will bill at an hourly rate.
  • Actual time to implement work will vary greatly depending upon final design.
  • Unless otherwise stated quotes are for building websites only. All text, images, audio, video and any other content to be supplied by the client.
  • It is assumed above that all text for the static content pages will be delivered as text files and do not include text entry.
  • Quoted prices remain valid for 30 days.

Project Scheduling

  • An estimate of overall project length will be provided at the start of work. Actual completion time may depend upon the number of revisions required, and is contingent on the client’s provision of content and availability for approval. All attempts will be made, however, to accomplish the work by the estimated date.

Consulting Rates and General Terms

  • For maintenance work and departures from the agreed quotes Flying Fox Multimedia charges normal hourly fees as follows:

  • A minimum charge of $44 (half an hour) applies for all jobs.
  • Flying Fox Multimedia may use the services of subcontractors for provision of any services.
  • Unless otherwise stated all billing for projects will be provided by Flying Fox Multimedia.

Payment

  • A non-refundable deposit of 30% of the estimated project cost is required prior to starting work, and will be applied to the final billing of the work.
  • Smaller jobs will be invoiced in two stages (deposit + completion); larger jobs may have three or more payment milestones.
  • Flying Fox Multimedia will bill on completion of the project, or, in the event that the project departs from intended schedule and requires further time for execution, monthly, for actual hours worked.
  • Should client supply of content hold up the completion of the project Flying Fox Multimedia will invoice for final payment. Any content yet to be added or tasks yet to be completed by Flying Fox Multimedia as part of final billing will be noted at this time.
  • After client signoff on project completion any additional work will be charged at standard rates (see above).
  • All payments are due in 14 days; if payments are overdue work will stop until they are received.
  • Overdue accounts will be charged 3.0% interest per month.
  • Invoices will come from and should be remitted to:
    Flying Fox Multimedia, PO BOX 431, Bellingen NSW 2454 Australia.
  • Unless otherwise requested invoices will be sent by email.
  • Domain registration payments are non-refundable.
  • A maximum of 50% of web hosting payments will be refunded.
  • Hosting accounts may be suspended if payment is overdue.

Ownership

  • Upon full payment only, Flying Fox Multimedia grants a non-transferable, non-exclusive license to use all materials produced in this project. Upon transfer copyright ownership of the content of the site and all imagery created for it will belong exclusively to the client.
  • Unless otherwise agreed in writing copyright and any intellectual property rights relating to any software provided will remain the property of Flying Fox Multimedia.

Representations and Warranties

  • Clients represent and warrant that the content or any other materials provided to Flying Fox Multimedia, including without limitation, the text, graphics, photos, designs, etc. do not violate or infringe upon any third party’s copyright, patent, trademark, trade secret or other proprietary rights. 'Content' refers to all text, pictures, sound, video, graphics and other data and Intellectual Property provided to Flying Fox Multimedia that clients intend to incorporate into websites as well as the general image, formats and appearance (i.e., the “look and feel”) of the web site, including without limitation, the size and placement of the icons and images, text, the distinctive headers on the page, the colors, designs and all other aspects of the web site, as amended from time to time.
  • Flying Fox Multimedia represents and warrants that the that materials provided to clients, including (but not limited to) the text, graphics, photos, and designs, etc., to the best of Flying Fox Multimedia’s knowledge, do not violate or infringe upon any third party's copyright, patent, trademark, trade secret or other proprietary rights, and will notify clients of all licensed third party software being utilized.
  • Except as otherwise provided herein, services are provided as is. Flying Fox Multimedia makes no warranties, whether written, oral or implied, including but not limited to warranty of fitness for purpose of merchantability.

Termination

  • Clients have the right to terminate projects prior to completion, with or without cause. Should clients terminate this project without cause prior to its completion, they agree to pay Flying Fox Multimedia immediately for all hours worked and all reasonable expenses incurred, and will surrender all rights to the retainer fee. Flying Fox Multimedia may elect to retain copyright until the site is paid for in full.

Referrals Programme

For each successful referral we reward you with a credit on your account. The credit will be 10% of the first invoice sent to the new client, up to a maximum of $160.

  • A successful referral is one that results in the referred client purchasing services from Flying Fox.
  • Credits can be used to pay for services but will not be paid in cash.
